Background: The Q****[whole name not given] was an old fashinioned "hillbilly" clan and I inadverantly got on the good side by taking the older son, Tommy Q, home when I found him late one night, stiff as a board, from drinking poorly made moonshine. I was new and deviated from the procedure of arrest and cuffing around. They couldn't believe Tommy was brought home & not even a ticket given.
The younger son Billy Q shot a man 3 times. He admitted to that in court. Testimony corroborated the shooting. After the forensic specialist testified and the state police testified, Billy Q was let free and given his gun back. Why?
[this happened outside my jurisdiction but I am sure of the facts.]

RM - it was in VA but we're close enough to WV for the possibility to exist that they were related but it doesn't enter into this incident

Hiccup is correct: The man was already dead.
Two of Billy Q's friends beat the person to death; Billy was there but not involved. One of them said, "I think we killed him". Billy and the others checked and lo and behold he was dead. Billy said, "I always wanted to shoot this fucker" and pulled out his gun and let fly.
When Billy Q's court appointed lawyer pointed out that there is no Virginia law prohibiting the shooting of a dead person, and that the State witnesses had verified the person was indeed dead, Billy was sped on his way and told to come back later to pick up his revolver
