Title: Salvaging the project?

Have you guys considered fitting this remake within fair use laws by constituting it as a parody rather than an unauthorized remake? Instead of using the copyrighted characters, use ones of your own design intended to make parody of the original game in a 3d setting (note that if some third party should later decide to reskin the characters, it's out of your control and not your responsibility).
Don't let the lawyers intimidate you by flashing copyright threats. There are legal protections for projects like this when they are non-profit and distributed without charge. Inform yourself of your rights and abide by them, and you'll find that the project can go on. Continuing to call it "Chrono Remake", however, would be one of the things you'd want to stop.

We've discussed the possiblities and the copyright issues among ourselves here on the team, and we've decided to work on the project as it is and see it through to the end unless we recieve a C&D from Square.
I believe I speak for the team when I say that we are all very proud of what we're trying to do - and if we ever do recieve that C&D from Square it will be framed and hung on our wall.

What I hope is that SE doesn't mind us doing this, and if they indeed send us a C&D that they would let us change to the less optimal solution, that is making a parody.
But usually they don't give second chances since when people get a C&D the only communication is with their representants, most of the times the company is only contacted later about the situation and didn't even know that a C&D was sent.

Good luck with the project, and please never give up! Just your site itself invokes an amazing feeling of nostalgia and longing to play the journey again, and I REALLY look forward to seeing more of Chrono Trigger. Please keep going no matter what.... you have my support.

if u dont want a C&D letter... heres what u do:
change the names of the characters
eg, Crono becomes Cranno, and he now has green hair
places look a bit different
eg, a table in the middle of the world map.. that way you can say you have a different map.
Give ur characters different weapons,
eg: Cranno now uses a sharp wooden walking stick.
add 1's onto the end of all timelines
eg, instead of 1000 AD, it's not 1001 AD.
lavos is now, Lavoz
and then change the game to
The Cranno Trigger, or " The Time Egg"
or something...
and a few days after its released... just drop out a patch that changes it all...

I'm not tryin' to dis your work, it's fantastic. I'm just wondering, how are you different from the CT Resurrection? Obvious are the styles, but were they trying to make money off of it, and your copy is as you stated going to be free? I'm not entirely following the real differences between why they were shut down and you were not. No offense, or at least, I'm not trying to be offensive. Keep up the good work.

Yes, this MOD will be free.
The biggest difference between the CTRP and CT:R is that we are remaking the entire game.
It is a possibility that CT:R was shut down due to some legal difficulties in the area of consoles.
If this is the case, we have no reason to worry, since we are not even considering porting our project to any console.

I just want to add to Al's post that our MOD project is a total conversion for ut2k4 and won't be released to anyone who doesn't have a PC and ut2k4 thus reducing the ammount of people that will be able to play the remake.
However SE reasons were their own so we can only imagine why they closed CT:R, despite what was written in their C&D, they have pretty much the hability to request removal of anything that is using any of their TM's, including fansites, artwork etc... The question here is if they indeed find us harmfull to their buisiness, in the end we're just doing an animated tribute for fans personal enjoyment, it's not much different than someone doing a Flash movie with CT characters, or a Doujinshi (fan manga).
If they find us harmfull they are indeed being unrealistic, no one cares about us doing this and everyone knows who made Chrono Trigger, Square... It's not like people won't buy CT because we're doing this remake.

you know.. in my opinion.. I don't think this project will receive a C&D letter.
why?
well, because this project is made with someone else's engine (Unreal script)
and the models aren't as GREAT as CT:R.. I'm not saying that the models are bad.. but you gotta admit that CT:R's model (e.g. Chrono.. Magus) was like a PROFESSIONAL.. its like Toriyama's character came from 2D to 3D!! Don't get me wrong, I really love this project's map.. the picture of the fair and such are really nicely done..
however, this seems to be like a more "fan-made" project than CT:R. Even though CT:R was made by fans.. their quality was of a pro.. I heard they written it from scratch.. excellent models and textures.. it seemed like Square did the project themselves!
well, that's just my opinion however, good luck!

Yea, well I don't mean to sound mean, but it is CT:R's own fault for getting that C&D command (I'm assuming, this is all off of my own assumption, feel free to correct me)
I mean, if you are going to remake a game an dplan to release it on console, I would expect SE to shut them down, sicne they are profiting on their creation. I wonder...is it possible for CT:R to make the game a standalone free game if they watned to? I can understand if they don't anymore, but to C&D mean you have to stop production, no matter what?

Where are these crazy rumors coming from? CTR was not profiting at all off of it. The console versions were being made only for the members of the development team, and no version was going to be sold.

You got some info wrong Link1802.
CT:R was planning to create for their personal enjoyment and learning experience two internal builds (this means they wouldn't be realeased to the public) for XBox and GameCube.
Unfortunatly their mistake was talking about this in the forums, since most people took for granted that they would release this or it would maybe get leaked. This lead to many miss information and people who got the facts wrong, and maybe SE too.
Though it is not stated in CT:R C&D maybe was one of SE's concerns about CT:R that lead to them issueing the C&D.

I read about CTR being shut down in some game magazine and was extremely pissed... cause chrono trigger rules!!! I do hope you guys will never give up!! Keep up the good work!

I've kept tabs on this remake project for quite some time now, and I can't wait for something solid to be released for the community.
As far as this quote goes, the main reason you will NEVER receive a C&D command is because you're -basically- making a mod for UT2004. The other project that recently got shut down had made the game with their own PC engine (as far as I know). SE has no grounds to order a C&D letter to the creators of this mod, just like how no one could order a C&D letter if someone decided to create a LOTR mod for UT2004/any other PC engine. Run a search for LOTR mods for Neverwinter Nights (Aurora Engine), and observe the madness.
Maybe I'll create a username and account for these boards sometime in the near future. This project looks extremely promising! Great work so far, and keep at it! :)

05.07.04 - Chrono Trigger: Resurrection Web Site Launched!
Welcome to the home of the Chrono Trigger: Resurrection project! We have been vigorously working for the past year on this project and we're excited to bring it to the public eye, in full, for the first time.
Chrono Trigger: Resurrection is a 3D remake of Square's SNES classic, Chrono Trigger. The demo, which will be released Christmas 2004, re-creates ten of the best scenes from the original game.
Currently, the demo is 25% complete. We expect to release a trailer when the demo is over 50% completed, which should be around the end of August. When the project is completed, only the PC version will be released to the public for free. The GameCube and Xbox ports are internal and only official developers (for those respective platforms) will be able to play them.

That was posted on the CTR site. Now re-read the third paragraph. It said that "...only the PC version will be released to the public for free." Now thats not saying that it'll cost, it is free! But that isn't what I wanted you to look at.
Look at the next part. "The GameCube and Xbox ports are internal and only official developers (for those respective platforms) will be able to play them."
What does that mean? The developers of there respective platforms will be able to play them, but also if it got to the company that makes the platforms, it would be a desaster. It didnt include PS2 in it too, so what does that tell you? that they are trying to get an audience to go out and buy the XBox and GameCube.
What I'm trying to say is that it may not cost to play or download on the net, but when they included the part about the developers being able to play it, it seemed that they were trying to promote a product and sell it, or even if they didnt sell it, most of the people working on the project are already in the movie and/or gaming industry. they were making CTR not only as a fan remake, but also to put into their portfolio and get somewhere in the industry as well.
Now had they not been in the industry(or had only one person been in there but not been the top remake person) the C&D might not have come. It would have been entirely fan based, and who knows, the people who made it might have been offered positions in companies. Also, if you actually looked and searched for interviews with and/or on the CTR makers you would find quite a few interviews. thats how square probibly got the word faster than anything else. Square then looked into it and decided that other people would be making money in the long run off of CTR, thus issuing a C&D letter.

Yep, you got it. Its always good to look arround and find the flaws about stuff. If you don't you wouldn't be able to fix a problem that could cause major damage later. In the Air Force we called it ORM(Operational Risk Management). This was like the mathematical process PEMDAS(remember) or the scientific method to solve problems. It was used to identify hazords and fix/remove what ever you could inorder to make the job more safe.
