Since we have no law preventing the uttering of hateful statements in forums controlled by the region of Canada, I hereby propose the following draft legislation.
Keep in mind that I drafted this one up very quickly, just so the idea could be thrown out there for discussion. I look forward to hearing views on the necessity of such a law, and how it can be improved.
I'm on record as saying this law is required. I'm tired of seeing stereotypical slurs and insults hurled at various groups. I thought that our region would be immune to such hatred, but Sputnik appears to have proven me wrong in the latest UN thread - hence my drafting of this proposed legislation.
An Act to prevent the incitement of hatred
WHEREAS Canadians recognize the individual worth and dignity of every member of the human family, and this principle underlies the Universal Declaration of Human Rights, the Canadian Charter of Rights and Freedoms, and other solemn undertakings, international and domestic, that Canadians honour;
AND WHEREAS Canadians recognize that
(a) implicit in the above principle is the right of all individuals to be treated in all matters solely on the basis of their personal merits, and to be accorded equality of opportunity with all other individuals;
(B) to protect this right it is necessary to restrict unreasonable incitement of hatred against individual groups, including discrimination based on stereotypes or generalizations about groups with whom they are or are thought to be associated,
© these various protections for the human rights of Canadians are of such fundamental importance that they merit paramount status over all other laws of the province;
NOW THEREFORE the Region of Canada enacts as follows:
PROHIBITED CONDUCT
"Incitement of Hatred" defined
1(1) In this Code, "incitement of hatred" means
(a) any public statement made by s member nation of Canada in a public forum created for discussion of the affairs of the region of Canada, whereby a person who leads or represents a member nation:
(a) makes unsubstantiated negative statements about any group of individuals based on characteristics listed in subsection 1(2);
(B) propegates a sterotype about any group of individuals based on characteristics listed in subsection 1(2);
© utters hateful statements, insults or slurs towrds any group of individuals based on characteristics listed in subsection 1(2).
Applicable characteristics
1(2) The applicable characteristics for the purposes of clauses 1(1)(a) to © are
(a) ancestry, including colour and perceived race;
(B) nationality or national origin;
© ethnic background or origin;
(d) religion or creed, or religious belief, religious association or religious activity;
(e) age;
(f) sex, including pregnancy, the possibility of pregnancy, or circumstances related to pregnancy;
(g) gender-determined characteristics or circumstances other than those included in clause (f);
(h) sexual orientation;
(i) marital or family status;
(j) source of income;
(k) political belief, political association or political activity;
(l) physical or mental disability or related characteristics or circumstances, including reliance on a dog guide or other animal assistant, a wheelchair, or any other remedial appliance or device;
(m) profession or employment class.
OFFENSE
2 incitement of hatred is hereby deemed to be an offense, punishable by a penalty that may, at the discretion of the presiding judge, include:
(a) a formal public caution of the offending member nation;
(B) a suspension of the offending member nation from the region of Canada for any period of time; or
© lifetime expulsion of the offending member nation from teh region of Canada.
3. Prosecution of offenses shall be handled by the complainant, or a complainant's representative. Defense of an offense shall be handled by the defendant or the defendant's representative. The matter shall be heard by a neutral justice of the Supreme Court of Canada.
Looks good Bweezy. Seems like a good idea to extend the current anti-flaming rules of the game. However, I'd like to add a clause that allows for dealing with NS cheaters. (those who use more than one UN nation) I think that it is appropriate that these players be expelled from Canada altogether.
