Alright, so theoretically speaking if an eighteen year old who had their own cell phone in their name that they paid for, got that phone taken away from them against their will by a parent, could said eighteen year old call the phone company and claim that the phone was stolen (technically true) and get a new phone without having to pay the usual cancellation fee, etc...This eighteen year old is still in high-school and would very much like to continue to have a place to live until after graduation...

Well, not even theoretically because in reality ur parents not the legal owners of it took it away w/o ur permission so that is 'technically' stolen, but even if some1 say well u know who has it, but that does not mean u can get it back from that, so yea i would say u could

If it was stollen, why don't you steal it back from the said thieves? If you are questioned about it, say you have no idea what they are talking about, and if they lost it they should have to get you a new one. You could turn this into a positive experience by doing that, or not. :P

It would be an option if: I had not already done this and got it taken away again. It were not now in a locked fire safe in a locked room...the room is very easy to break into with the use of a butterknife and a loose doorjamb, but without the key, the firesafe is inpenetrable. and chances are she would realize it was gone and find a way to get it back...so i don't know...it is complimicated

Well that sucks. If you push the issue any farther you will probably just make your relationship with your parents worse, which probably isn't worth a phone.

For it to be called theft you have do have two things. 1) Your parents have to have taken the phone from you against your will and without consent. and 2) You need to call the police inform them that your parents stole your cell phone and either have them get it back (possibly through court), or get the police report. once the cell phone is considered stolen you can call up the phone company and request a new one according to any insurance you have on it.
just a note: if your parents pay your phone bill then you might want to consider leaving it as it is. because they own the insurance and any clams and will have any new phones sent to them. but you can sue them for 2 times the value of the phone. (in the us)
another note: if you still live with your parents you probably don't want to do this anyway. Because even though you have your rights as an adult and they cant take anything from you against your will. they don't have to let you live on their property. unless your paying rent in that case go ahead because then they have to give you a 30 day eviction notice before they can kick you out. (and have to have a good reason to do so too. see landlord/tenet laws for your state for more info.)
PS: Next time just try not to piss them off.

a. i pay for it and it's in my name
b. the whole me wanting a place to live prevents me from taking any specific action against my mom
c. i don't pay rent
d. my mom cancelled the long-distance on our home phone years ago.
e. my situation is hopeless
and fyi to ih8....i do behave myself... :P
